Terms of Use

Voice Capture is operated by Mgr. Martin Krček, Šmilovského 336/6, 627 00 Brno, Czech Republic, company ID 64281736, martin@krcek.cz. By using the app you agree to these terms. How we handle your data is described in the Privacy Policy (in Czech).

This is a convenience translation of the Czech original, which is the governing version.

1. What the service does

Voice Capture is a voice recorder for iPhone. It can transcribe a recording directly on the phone; from the transcript it can then optionally create AI outputs based on templates (meeting minutes, tasks, a journal and more) and, for recordings with audio, an advanced audio analysis. On request it stores the audio in your archive and makes it available on the web as well. The original transcript is an immutable original — AI outputs are created alongside it and never overwrite it.

You control separately what leaves the phone: sending the transcript, sending the audio, and AI processing are three independent choices. You set them permanently in Settings, or one-off for a specific recording — the details are described in the Privacy Policy.

2. Beta testing

The app is in a public beta test (TestFlight). This means it changes quickly, may contain bugs, features may be added, changed or removed, and the service may be unavailable or temporarily switched off. Do not rely on the app as the only storage for important recordings — back up anything important elsewhere too (export to Files, iCloud and the like). Beta versions have a limited lifetime given by the TestFlight rules.

Version 2.0 is built from scratch and starts with an empty cloud history. Data from the older version is not migrated — it stays where it is until you delete it. Recordings stored on your phone remain available in both versions.

3. Account

The basic features work without registration — an account is created automatically and anonymously. You can optionally link it to Sign in with Apple, which gives you access to your recordings on the web and lets the account survive a reinstall. You are responsible for what happens under your account; protect access to your device and your Apple ID.

You can delete the account and all data at any time directly in the app (Settings → Account → Delete account and data). This is irreversible.

4. What is free and what is paid

Recording, playback, markers, history and transcription created directly on the phone are free and unlimited — in this mode a recording never has to leave your phone at all.

What is paid is heavy processing in the cloud — in particular AI transcription from audio and advanced audio analysis. Creating AI outputs from a transcript is included in a monthly fair-use limit. Each account also gets a one-time free credit to try things out. The current limits and prices are always shown in the app and in the App Store and take precedence over this description; the limits exist to protect the service from abuse and may change — we will announce any substantial restriction of a paid feature in advance.

Subscriptions are purchased and paid exclusively through the App Store (Apple In-App Purchase); the price is shown before purchase. A subscription renews automatically until you cancel it — you manage it in your Apple account settings. Refunds are handled by Apple under its own rules (reportaproblem.apple.com).

5. AI output

Transcripts and AI outputs (minutes, tasks, key points, journal entries, speaker identification) are generated automatically by AI, and AI makes mistakes — it can drop a word, mishear, flip the meaning, attribute speech to the wrong speaker, or make up something that was never said. It tends to be worst with poor audio, people talking over each other, technical terms and foreign names. Do not treat the output as a faithful record. For anything important — legal, medical, financial or work decisions — verify the information against the original recording. We do not guarantee accuracy and are not liable for what you do based on AI output. This also applies to the journal templates: they are not a medical service or medical advice.

6. Your content

What you record stays yours. These terms give us no ownership rights to your content. To provide the service, you grant us only the permission necessary to store the content, transfer it to our processors (Google) and create outputs from it (the transcript and template-based AI outputs) — solely so that you receive them. The permission ends when you delete the content, and at the latest when you delete your account.

You can take your recordings and transcripts with you at any time — by exporting from the app, via the web, or with a personal API key (section 7). There is no lock-in.

7. Connecting other software (API keys)

In the app you can create a personal key that lets another program access your data — a journal app, Shortcuts, your own script. A key has read or write scope; it cannot create further keys, delete the account or download audio. You are responsible for who you give a key to and what they do with your data — we have no control over that and do not vouch for such programs. You can revoke a key at any time in the app; if you suspect misuse, revoke it immediately. The interface may evolve, and if we were to change it in a way that breaks integrations, we will give notice in advance.

8. Recording other people

The rules for making audio recordings differ by country and by situation — in some places you need the consent of all participants in a conversation, in others it is enough that you are a participant yourself; in the Czech Republic, personality rights under the Civil Code apply on top of that. Do not record people without their knowledge where the law does not allow it. You alone are responsible for the lawfulness of every recording — including obtaining any required consents. The app is just a tool; we do not and cannot examine how a recording was made.

You can stop using the service at any time — by deleting your account in the app or by uninstalling it. We may suspend or terminate access to the cloud features or to an account in the event of a material breach of these terms, normally with prior notice (without notice only where damage is imminent or the law requires it). If we were to shut the service down entirely, we will give notice in advance and allow you to export your data.

11. Liability

The service is provided "as is". We aim for reliable operation, but we cannot guarantee uninterrupted availability or freedom from errors — we also depend on our suppliers (Google, Apple). To the extent permitted by law, we are not liable for indirect or consequential damages, lost profits or loss of data.

These limitations do not apply where the law excludes them — in particular they do not limit consumer rights under mandatory rules, liability for personal injury, or liability for damage caused intentionally or by gross negligence.

12. Changes to these terms

We may change these terms — above all as the app evolves from beta to a full release. We will announce substantial changes in advance in the app or by e-mail. The current version is always at this address, with the date of the last update at the top. If you do not agree with a change, stop using the service and cancel any subscription.

13. Governing law

These terms are governed by the law of the Czech Republic. If you are a consumer, this does not affect your rights under the mandatory rules of the country where you live. Consumers in the Czech Republic may turn to the Czech Trade Inspection Authority (adr.coi.cz) for out-of-court dispute resolution.
